Introduction

AGREEMENT BETWEEN USER AND ParkDIA™

The ParkDIA Web Site is comprised of various Web pages utilized by ParkDIA, LLC. ParkDIA is operated by PNF, a professional parking management company that leases, manages and owns parking facilities. http://www.pnf.com

The ParkDIA Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the ParkDIA Web Site constitutes your agreement to all such terms, conditions, and notices.

MODIFICATION OF THESE TERMS OF USE

ParkDIA reserves the right to change the terms, conditions, and notices under which the ParkDIA Web Site is offered, including but not limited to the charges associated with the use of the ParkDIA Web Site.

LINKS TO THIRD PARTY SITES

The ParkDIA Web Site may contain links to other Web Sites (“Linked Sites”). The Linked Sites are not under the control of ParkDIA and ParkDIA is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. ParkDIA is not responsible for webcasting or any other form of transmission received from any Linked Site. ParkDIA is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by ParkDIA of the site or any association with its operators.

Privacy Policy

Personal information will not be sold or shared with any other entity or agency not utilized by ParkDIA except in the performance of reservations, payment, or periodic correspondence supporting the parking facility and its clientele. ParkDIA reserves the right to market its services, offers, and promotions via email and/or text message for registered users. ParkDIA will not sell or provide any personal information to third parties for their promotional or marketing purposes.

All communications will contain an unsubscribe link as well as a link to manage your unsubscribe options.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the ParkDIA Web Site, you warrant to ParkDIA that you will not use the ParkDIA Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the ParkDIA Web Site in any manner which could damage, disable, overburden, or impair the ParkDIA Web Site or interfere with any other party’s use and enjoyment of the ParkDIA Web Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the ParkDIA Web Sites.

USE OF COMMUNICATION SERVICES

The ParkDIA Web Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

 

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
  • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
  • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
  • Conduct or forward surveys, contests, pyramid schemes or chain letters.
  • Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using and enjoying the Communication Services.
  • Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
  • Violate any applicable laws or regulations.

 

ParkDIA has no obligation to monitor the Communication Services. However, ParkDIA reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. ParkDIA reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

ParkDIA reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in ParkDIA’s sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. ParkDIA does not control or endorse the content, messages or information found in any Communication Service and, therefore, ParkDIA specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized ParkDIA spokespersons, and their views do not necessarily reflect those of ParkDIA.

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

MATERIALS PROVIDED TO ParkDIA OR POSTED AT ANY ParkDIA WEB SITE

ParkDIA does not claim ownership of the materials you provide to ParkDIA (including feedback and suggestions) or post, upload, input or submit to any ParkDIA Web Site or its associated services (collectively “Submissions”). However, by posting, uploading, inputting, providing or submitting your Submission you are granting ParkDIA, its affiliated companies and necessary sub licensees permission to use your Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission.

No compensation will be paid with respect to the use of your Submission, as provided herein. ParkDIA is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in ParkDIA’s sole discretion.

By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE ParkDIA WEB SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. ParkDIA AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE ParkDIA WEB SITE AT ANY TIME. ADVICE RECEIVED VIA THE ParkDIA WEB SITE SHOULD NOT BE RELIED UPON FOR PERSONAL, MEDICAL, LEGAL OR FINANCIAL DECISIONS AND YOU SHOULD CONSULT AN APPROPRIATE PROFESSIONAL FOR SPECIFIC ADVICE TAILORED TO YOUR SITUATION.

TERMINATION/ACCESS RESTRICTION GENERAL

ParkDIA reserves the right, in its sole discretion, to terminate your access to the ParkDIA Web Site and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the State of Colorado, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Adams County, Colorado, U.S.A. in all disputes arising out of or relating to the use of the ParkDIA Web Site. Use of the ParkDIA Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and ParkDIA as a result of this agreement or use of the ParkDIA Web Site. ParkDIA’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of ParkDIA’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the ParkDIA Web Site or information provided to or gathered by ParkDIA with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and ParkDIA with respect to the ParkDIA Web Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and ParkDIA with respect to the ParkDIA Web Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.

The names of actual companies and products mentioned herein may be the trademarks of their respective owners.

The example companies, organizations, products, people and events depicted herein are fictitious. No association with any real company, organization, product, person, or event is intended or should be inferred.

Any rights not expressly granted herein are reserved.

NOTICES AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT

Pursuant to Title 17, United States Code, Section 512(c)(2), notifications of claimed copyright infringement under United States copyright law should be sent to Service Provider’s Designated Agent. ALL INQUIRIES NOT RELEVANT TO THE FOLLOWING PROCEDURE WILL RECEIVE NO RESPONSE. See Notice and Procedure for Making Claims of Copyright Infringement.

Self-Parking

ParkDIA’s self-parking options include Uncovered and Covered. Uncovered is defined as parking your vehicle yourself in a parking space in the outdoor areas of ParkDIA. Covered is defined as parking your vehicle yourself in a parking space under the canopy structure.  Regardless of parking option chosen, patrons must follow signs and the direction of the ParkDIA staff to specific areas or spaces. This is for your safety and the safety of other patrons. Failure to follow these directions may result in denial of service or vehicle towing at the owner’s expense.

Parking options are priced per 24 hour period plus any part thereof. Prices are subject to change. Quotes are valid at the time of booking only. The number of “days” (24 hour periods) charged when you pre-book is calculated on the basis of the times you select when making your booking. However, if your actual entry and exit time changes from that specified in your booking and as a result your actual elapsed time in the parking facility runs into another 24-hour period over and above that booked, you will be liable for any additional charges at the prorated rates as follows: first 30 minutes over are free, 31 minutes to the first hour will require an additional $3.00. Each 60 minute increment thereafter will result in an additional $3.00 until the parking options daily rate is reached. The amount must be settled before you leave. Please note that this applies irrespective of the reason why you are late back to the facility.

An applicable fee is calculated on the subtotal of parking charges less any promotions and offers. This payment is levied by the Denver International Airport and is non-negotiable. As it is a fee and not a tax, tax exemption laws do not apply.

If you pull a ticket on entry to ParkDIA, you will need it to exit. On exit, please follow the instructions on signs, digital displays, or as directed by ParkDIA staff. The charge for a lost ticket is 14 days of parking at the posted rate of the option previously chosen.

When you have parked your vehicle, it is your responsibility to:

  • Lock your vehicle securely;
  • Fully close all windows of your vehicle;
  • Apply your emergency brake properly;
  • Engage any steering lock, alarm or immobilizer you have;
  • Not leave any animal or person within your vehicle;
  • Ensure that your possessions are placed in a locked compartment and are not on display.

 

ParkDIA cannot be held responsible for any loss or damage whatsoever occurring to your vehicle or its contents. ParkDIA and its employees DO NOT accept any valuables or other articles for safe custody.

You must drive carefully and responsibly in the facility. You must also ensure that any children and animals are properly supervised and are at all times accompanied when they are using the facility. Please be aware of all vehicles in motion within the facility.

You must comply with all directional signage and other instructions when in the facility.

ParkDIA does not accept liability for:

  • Damage to your vehicle (whether caused accidentally or by way of vandalism);
  • Theft of, or from, your vehicle;

 

While ParkDIA uses reasonable endeavors to ensure that the facility is secure, ParkDIA cannot guarantee against criminal acts by third parties.

Shuttle Service

The following terms apply to use of the shuttle service:

Please be aware that you need to leave an appropriate amount of time to reach the terminal building from ParkDIA using the shuttle service. ParkDIA strives to dispatch shuttles every five minutes (in normal traffic conditions) and the frequency of shuttles may be tracked on the ParkDIA App, but in addition to this you should ensure that you factor in time to find a space, retrieve your luggage out of the car, lock your car and allow for loading or unloading of additional passengers or luggage. ParkDIA does not accept responsibility if you miss your flight or your airline check-in has closed because of a failure to allow sufficient time to get into the facility and to the terminal.

Please ensure that you remember to point out all your luggage to the shuttle driver as she or he offloads it from the shuttle when you arrive at your terminal. ParkDIA does not accept responsibility if you miss your flight or if your airline check-in has closed because you have to recover luggage which was left on the shuttle or at the facility.

ParkDIA does not accept liability for increased duration of transfer times from the facility to the terminal building which are caused by exceptional volumes of traffic, road works or accidents, mechanical breakdown or failure, adverse weather conditions or staff shortages (howsoever caused).

In using ParkDIA, you agree to abide by any additional terms of such use that may be displayed in or around the facility. These may include, but are not limited to, terms regarding permissions to be in the facility and penalties for parking in prohibited places.

We reserve the right to move any vehicle within or outside the facility to the extent that we deem necessary to carry out the efficient management of ParkDIA.

If your vehicle is parked in a manner which (in our reasonable opinion) is unsafe, is outside of a designated parking space, impedes the free flow of traffic in and around the facility or is in breach of any restriction marked on signage or on the ground in the car park (or otherwise brought to your attention), we may:

 

  • Cause your vehicle to be removed without notice, and you will be responsible for the costs of such removal and recovery; and/or
  • Issue a parking charge notice to you for such amount as may be published at the facility from time to time in respect of the relevant breach.

 

The following are not permitted in the facility, and we reserve the right to refuse to allow you to use the facility if you carry out any of these activities in the car park:

 

  • Conducting any service work, cleaning or repairs to your vehicle;
  • Carrying out any business activity, including but not limited to in connection with selling, hiring or other disposal of your vehicle;
  • Filling or emptying of fuel tanks;
  • Misusing or damaging any part of the facility;
  • Parking outside of a designated parking space (appropriate to your vehicle) or as otherwise instructed by ParkDIA staff;
  • Driving dangerously or too fast, (lot speed limit is 5 miles per hour);
  • Making unnecessary noise or nuisance, including playing music in a way that annoys other users of the facility or people living or working nearby;
  • Filming or taking photographs
  • Cooking or lighting fires;
  • Using the full facilities of a camper van, including but not limited to the toilet, bathroom and kitchen;
  • Doing or attempting to do anything which is a criminal offense;
  • Spending excessive time (as we may determine) in your vehicle in the facility. This includes sleeping in your vehicle.
  • No weapons or firearms are allowed at Park DIA.
  • Marijuana, marijuana products, and all illegal drugs are prohibited.

Reservations

Reservations for parking are available in one of two ways: through the ParkDIA website or the ParkDIA mobile app. Both options reserve parking based on the number of days booked, parking option chosen, and rate option available to you. While a reservation is never required to park at ParkDIA, it is highly recommended during holidays and peak travel times.

In consideration of your payment to ParkDIA of a reservation fee or unpaid reservation, ParkDIA agrees to make available to you one (1) vehicle parking space at facility commencing at the Check-In Date/Time which you designated. You acknowledge that the reservation constitutes consideration for the right to make such reservation only, and is payable for the use of such parking space, or any other applicable fees or charges associated with the parking of a vehicle at the facility.

Cancellation Policy. You may cancel your parking reservation any time before the reserved check in time by contacting the facility by telephone at (303) 288-7275. The reservation amount will be refunded to you in the form of a credit issued to the credit card that you used to make the reservation.

Grant of License. Upon your arrival and check-in at the Facility at any time within a one (1) hour period commencing at the designated check in time, you shall be deemed to have been granted a license to park and lock one (1) vehicle in the applicable designated area of the facility for the period of the reservation. All other restrictions as posted at the facility apply.

Guarantee Policy. In the unlikely event that you arrive at the Facility within the one (1) hour period commencing at the designated check in time and no parking space is then available for your use, ParkDIA reserves the right and offers valet parking as a supplement at no additional charge. All rules and restrictions apply as outlined in the Valet Parking section of these Terms and Conditions. In the event you refuse valet service, and no other options are available, any pre-paid reservation fees will be refunded in full.

Frequent Parker Program

How it works

The ParkDIA Frequent Parker Program (FPP) is meant to reward our loyal members with free parking based on their online reservation spending (the cheapest and easiest way to park with us!).  We keep it simple, you get 80 points awarded when you make your first reservation with us. From that point forward you get 1 point for every dollar spent with us.

We round to the nearest whole dollar for the award of points, so if you pay $28.49 you get 28 points, but if you pay $28.50 you get 29 points.

Unused points expire 24 months after their award.

Use of points is straight forward, 80 points gives you a free day of uncovered parking and 160 points gives you a free day of covered parking. You can use as many free days as you have in a single reservation.

Points can be used immediately after award.

 

Frequent Parker Program Terms and Conditions

ParkDIA shall not be responsible for any incidents resulting from incomplete and insufficient information entered by members. ParkDIA shall also not be responsible for any loss of data or information for any other reason whatsoever.

In the event ParkDIA determines or has reason to believe that the information you provide is not current, is inaccurate, incomplete in any way, or that you have provided ParkDIA with false or misleading registration information, ParkDIA reserves the right to either suspend or terminate your membership.

ParkDIA reserves the right to modify or cancel the ParkDIA Frequent Parker Program at any time, without notice. Such modification or cancellation will be effective when posted on the website. Free days and membership levels are the property of ParkDIA and not the member. You cannot transfer to or combine reward days with any other person or program account.  Additionally, qualifying days cannot be transferred by operation of law, such as by inheritance, in bankruptcy or in connection with a divorce. Such modification may include, without limitation, changes in the terms and conditions for the awarding of free day(s), changes in the terms and conditions for the issuance of ParkDIA Frequent Parker Program and changes in terms and conditions for the redemption of ParkDIA free day(s).

ParkDIA, in its own sole discretion, reserves the right to refuse the membership of an applicant, without prior notice to the applicant. ParkDIA assumes no responsibility for any technical failure of the ParkDIA Frequent Parker Program online system. Every effort is made to ensure that information supplied to Frequent Parker Program Members is correct, however ParkDIA will not be liable for any inaccuracy, erroneous description, or information on the ParkDIA Frequent Parker Program and these Terms and Conditions.

Refund Policy

All sales of services and products through ParkDIA, its websites, and affiliates are final. Sales include services for parking, reservations for parking, and any variation to include hourly, daily, monthly, or special rates. Sales also include purchases of car care services and/or other products offered at the location or online.

Any request for refund for services, reservations or products must be submitted in writing and must include name, address, daytime telephone number, and any supporting documentation such as receipts, reservation confirmations, etc. Once received, request for refund is investigated by management and final determination will be mailed to customer. AT NO TIME IS ANY EMPLOYEE OF ParkDIA AUTHORIZED TO REVERSE CREDIT CARD CHARGES. Submit all required information for request of refund to:

Please allow 14 business days after receipt of refund request for investigation and processing.

Failure to follow this process or reversing or disputing credit card payments constitutes theft of services. Theft of services will be submitted to local authorities for legal process.

NOTE: Any free days awarded either through ParkDIA’s Frequent Parker Program membership or any other process, such as promotions, sales, or award programs have no monetary value. Use of free days within a stay are excluded in any consideration for refund or compensation of any kind.
